Welcome to Gamer Ghotu. By accessing or using our website, you agree to be bound by these Terms and Conditions. Please read them carefully before completing any transaction.

1. Description of Services

All payments made on this platform are fees paid by users ("Customers") to purchase a digital micro-service—specifically, the real-time triggering of custom on-screen software alerts, text-to-speech (TTS) features, and interactive live-chat software modifications during live digital streams. These transactions constitute a commercial purchase of a digital utility and software interaction service provided by the platform operator. Because these digital services are generated, rendered, and delivered instantly and automatically upon successful payment, all transactions are final, immediately binding, and strictly non-refundable. The Customer acknowledges that no physical goods, ongoing subscriptions, or tangible products are offered, and once the digital interaction is triggered in real-time, the service is considered fully fulfilled and ineligible for any refund, chargeback, or dispute.

2. Eligibility & Pricing

You must be at least 18 years of age to use this Platform. Users under the age of 18 may access the Platform strictly with the verifiable consent and active supervision of a parent or legal guardian, who agrees to be bound by these Terms on the minor’s behalf. All digital service prices and fees are clearly displayed on the checkout page prior to final processing. Because all alert features and software rewards are subject to immediate digital fulfillment upon payment confirmation, all transactions remain subject to the strict non-refundability terms outlined in Section 1.

3. Account & Compliance

Users must provide accurate transaction details during checkout. Unauthorized use of payment instruments, identity misrepresentation, or fraudulent chargebacks will result in immediate suspension from our interactive live-stream platform.

4. Payment Gateway & Security

We process all online payments securely through authorized Indian Payment Gateway Aggregators, including the Razorpay Payment Gateway. Your transaction details are encrypted and transmitted over secure SSL/TLS channels. For your privacy and security, we do not store, process, or have access to sensitive payment card details, bank credentials, or authentication data on our servers.

5. Minimum and Maximum Purchase Amount

The minimum purchase amount for any digital service transaction is ₹20 (Indian Rupees) and the maximum purchase amount per transaction is ₹10,000 (Indian Rupees).

6. User Conduct & Customized Text Content

Customers may optionally include a customized text message to be processed by the software interaction tool alongside their service fee. By submitting a message, you represent and warrant that your content does not contain material that is abusive, hateful, racially or ethnically offensive, sexually explicit, threatening, defamatory, invasive of another's privacy, or otherwise unlawful or objectionable. We retain absolute sole discretion to monitor, moderate, filter, edit, or permanently remove any message text from displaying on-screen without prior notice or liability. We reserve the right to terminate access or block any Customer who violates this policy. Furthermore, you grant Gamer Ghotu an irrevocable, worldwide, royalty-free license to display your customer username and message publicly across the Platform, including but not limited to live video broadcasts, streams, overlays, and stream leaderboards.

7. Individual Creator Platform & Direct Service Model

Platform Ownership & Operation: The platform "Gamer Ghotu" is owned, controlled, and operated exclusively by Nikhil Punia (the "Operator") as an individual professional.
Direct Service Model: The Platform operates strictly on a direct digital service fulfillment model. All service fees paid through the Platform are processed and remitted directly to the Operator in exchange for the software alerts described in Section 1.
Exclusion of Intermediary Liability: The Platform explicitly does not function as a third-party marketplace, commercial storefront, multi-vendor aggregator, or peer-to-peer payment routing facility. There is no onboarding, hosting, or payout distribution to third-party sellers, independent vendors, or external payees. Consequently, the Operator bears no marketplace intermediary liabilities or financial escrow responsibilities.

8. Cancellation & Refund Policy

All virtual stream alerts and software rendering services are final and non-refundable once delivered. Please refer to our dedicated Cancellation & Refund Policy for detailed guidelines on handling technical payment errors or duplicate deductions.

9. Disclaimer of Warranties & Limitation of Liability

9.1 "As Is" and "As Available" Baseline: The Platform, including all features, software tools, and streams, is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, Nikhil Punia and Gamer Ghotu explicitly disclaim all warranties of any kind, whether express, implied, statutory, or otherwise. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from a course of dealing or usage of trade.
9.2 Absolute Exclusion of Certain Damages: In no event shall Nikhil Punia, Gamer Ghotu, or any associated moderators, affiliates, or agents be liable to you or any third party for any indirect, incidental, special, consequential, exemplary, or punitive damages whatsoever. This exclusion applies to, but is not limited to, damages for loss of profits, loss of data, loss of goodwill, business interruption, computer failure, or any other commercial damages or losses arising out of or related to your use of or inability to use the Platform, even if advised of the possibility of such damages.
9.3 Financial Liability Cap: Notwithstanding anything to the contrary contained herein, the aggregate liability of Nikhil Punia and Gamer Ghotu for any claim, cause of action, or dispute arising out of this agreement—regardless of the form of action (whether in contract, tort, breach of warranty, or otherwise)—shall be strictly capped at and limited to a maximum total amount of INR 1,000 (Indian Rupees One Thousand Only).
9.4 Indemnification: You agree to defend, indemnify, and hold harmless Nikhil Punia and Gamer Ghotu from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from your misuse of the Platform, your violation of these Terms, or your violation of any third-party rights, including intellectual property or privacy rights.

10. Changes to Terms

10.1 Absolute Right to Amend: We reserve the right, at our sole and absolute discretion, to modify, amend, update, or replace these Terms at any time, for any reason, without prior direct notice to you.
10.2 Notice of Changes: Any updates, modifications, or replacements to these Terms will be made effective immediately upon publication on this webpage. The date of the latest revision will be conspicuously displayed at the top or bottom of this document under the "Last Updated" field.
10.3 Binding Acceptance through Continued Use: Your continued access to, interaction with, or purchase of digital services from the Platform following the posting of any revised Terms constitutes your unconditional, legally binding acceptance of those changes. If you do not agree to the modified Terms, your sole and exclusive remedy is to immediately cease all use of the Platform and discontinue ordering digital services.
10.4 User Responsibility: It is your sole responsibility to review this page periodically to stay informed of updates. The Operator owes no duty to individually notify users of standard policy updates.

11. Governing Law & Dispute Resolution

11.1 Governing Law: These Terms, your access to the Platform, and any transaction, claim, or dispute arising out of or in connection with Gamer Ghotu shall be governed by, interpreted, and construed strictly in accordance with the substantive laws of the Republic of India, without regard to its conflict of law principles.
11.2 Exclusive Jurisdiction: You explicitly agree that any legal action, suit, or judicial proceeding arising out of or relating to these terms shall be subject to the exclusive jurisdiction of the competent courts located in Sikar, Rajasthan, India.
